Every reasonable care has been taken to ensure that descriptions are accurate. However, all times quoted are approximate and aircraft pictured may not be exactly the same type on the day of the flight.
MERSEYFLIGHT LTD TERMS & CONDITIONS
1.1 The definitions and rules of interpretation in this clause apply in these terms: -
- 'Company' means Merseyflight Limited, trading as Merseyflight Air Training Company, of General Aviation Area, Liverpool John Lennon Airport, Liverpool L24 5GA;
- 'Course' means any pilot training or related course or programme (including a single trial flight) offered and provided by the Company from time to time;
- 'Flight Instructor' means the captain of the aircraft as appointed by the Company;
- 'Student' means any person accepted by the Company in writing on a Course.
1.2 A reference to a law is a reference to it as it is in force for the time being taking account of any amendment, extension, application or re-enactment and includes any subordinate legislation for the time being in force made under it.
1.3 Words in the singular include the plural and in the plural include the singular.
1.4 A reference to one gender includes a reference to the other gender.
1.5 Clause headings do not affect the interpretation of these terms.
2. OPERATIVE PROVISIONS
2.1 Quoted flight times are approximate and may vary due to volume of air traffic or other operational reasons. Flight time is defined as airborne time plus 15 minutes for taxi and checks.
2.2 Students under the age of 18 require the written consent of a parent or guardian. Parents or guardians must ensure that all children are properly supervised at all times.
2.3 Observers on (4 Seater) flights are restricted to family or friends of the Student and are welcomed aboard at the discretion of the Flight Instructor.
2.4 All flights are subject to cancellation by the Company at short notice. It is the responsibility of the Student to telephone the Company on 0151 907 1450 on the day of their flight to confirm arrangements. The Company will not be liable for any associated cost resulting from a cancellation at short notice.
2.5 Height restrictions apply. Strict weight restrictions apply - please contact the Company before your flight if above 16 Stone/102kg.
2.6 Purchased goods and services are non-refundable. Services purchased are transferable upon written request. Multiple services which are packaged together and sold as one may not be shared among multiple persons.
2.7 All pre-paid goods and services, including gift cards, Courses and lessons, must be claimed and used within 12 months unless specified otherwise. The validity of expired goods and services may be extended subject to an additional charge and at the sole discretion of the Company.
2.8 It is the responsibility of the Student to book their appointment within the relevant validity period if booking pursuant to gift card or pre-paid voucher or service and to present the gift card or pre-paid voucher on the day of the flight or commencement of the Course.
2.9 If the gift card or pre-paid voucher has been lost or misplaced the Company, at its discretion, may refuse to accept the gift card or pre-paid voucher or may levy a proportionate charge to be determined by the Company.
2.10 All Students must maintain a valid Company membership and insurance to fly. If the Student maintains an account with the Company the account must remain in credit.
2.11 If a booking is cancelled by the Student within 48 hours of the allocated slot time, or the Student arrives late for their flight, any pre-paid voucher will be invalidated and/or a re-booking fee will be levied.
2.12 In the event of a booking being cancelled by the Company due to weather, operational reasons or any other circumstances outside of its control the purchased goods/service remain valid, subject to the relevant validity period if booked using a gift card or pre-paid voucher, and may be rebooked for a mutually convenient date.
2.13 The Company will not be liable for any expenses or costs incurred from flight cancellations due to operational circumstances or any circumstances outside of its control.
2.14 If in the opinion of the Company it considers the aptitude, behaviour or attitude of a Student falls below that expected of a Student or the Student breaches the operations manual or standard operating procedures or the Student fails to maintain their account in credit, the Company may cancel a flight or a Course at its sole discretion and terminate the membership of a Student. Any refund, in full or in part, will be at the sole discretion of the Company.
2.15 All Students should ensure that they are in good health and if in doubt should seek medical advice from their doctor. This is the responsibility of the Student.
2.16 The Flight Instructor reserves the right to refuse to allow any person on board the aircraft if he suspects them to be under the influence of alcohol or drugs, or if he feels they may adversely affect the safe conduct of the flight in any way. No refund will be offered in such circumstances.
2.17 No photographic or recording equipment is allowed airside or on board the aircraft. Mobile devices must be switched off if being taken airside – flight mode is not allowed.
2.18 When airside, visitors shall stay with their escort at all times and are subject to, and will comply with, all current safety rules and procedures.
2.19 Whilst every precaution is taken for the safety of Students and their property, the Company will not be held liable for any loss, theft, damage or, as far as permitted, injury.
2.20 Smoking is prohibited once within the Company security perimeter.
2.21 All pilots of Company aircraft (including Students) must (a) certify their understanding and acceptance of all required Company manuals and documentation before undertaking any flight as commander of a Company aircraft, unless the same has been signed within the last 12 months or since the last amendment, whichever is the latter; and (b) comply with all rules and procedures as set out therein; and furthermore (c) comply with these terms and conditions.
2.22 These terms and conditions are governed in accordance with the laws of England & Wales.
